MGL c.149 and MGL c.30§39M Compliance

All projects that receive Massachusetts state and municipal funding are required to comply with the public bidding statutes – MGL c. 149 §44 and MGL c.30 §39M.  The intent of the statutes is to make the public bidding process more transparent and to ensure fair competitive bidding.  With some of the most complicated bidding statutes in the US, the Massachusetts bidding statutes have unique provisions such as filed sub-bids, sub sub-bids, wage rate requirements, and “or equal” provisions.
